Welcome to Bloomy. These Terms and Conditions ("Terms") govern your use of the Bloomy mobile application ("App") operated by Bloomy ("we," "our," or "us"). By downloading, installing, or using the App, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using Bloomy, you confirm that you are at least 13 years old and agree to comply with and be bound by these Terms. If you do not agree, please do not use the App.

2. Description of Service

Bloomy is an AI-powered wellness companion designed to support individuals navigating emotional challenges such as breakups, loneliness, and personal growth. The App provides:

• AI chat companion for emotional support
• Mood tracking and daily check-ins
• Guided wellness exercises (breathing, body scan, movement)
• Journaling tools
• No-contact tracking
• Daily affirmations and healing milestones
• Photo-based features (Roast My Ex, Chat Analysis)

3. Not a Substitute for Professional Help

Bloomy is NOT a substitute for professional mental health care. The App does not provide medical advice, diagnosis, or treatment. If you are experiencing a mental health crisis, please contact a licensed professional or call your local emergency services immediately.

The AI companion is designed to provide emotional support and companionship, not therapy. Always consult a qualified healthcare provider for medical or psychological concerns.

4. Subscriptions and Payments

• Bloomy offers subscription plans that unlock premium features
• Subscriptions are billed through Apple In-App Purchases
• Payment will be charged to your Apple ID account at confirmation of purchase
• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period
• You can manage and cancel subscriptions in your Apple ID Account Settings
• Free trial periods, if offered, will automatically convert to a paid subscription unless canceled before the trial ends
• No refunds will be provided for partial subscription periods

5. User Content

You are responsible for all content you provide through the App, including journal entries, chat messages, and uploaded photos. By submitting content, you represent that:

• You own or have the right to use the content
• The content does not violate any third party's rights
• The content is not illegal, harmful, or offensive

We reserve the right to remove content that violates these Terms without notice.

6. AI-Generated Content

Bloomy's AI companion generates responses using artificial intelligence. While we strive for helpful and supportive responses:

• AI responses may not always be accurate or appropriate
• AI-generated content (including roasts and chat analysis) is for entertainment and informational purposes only
• We are not liable for any actions taken based on AI-generated advice
• The AI does not have real emotions or consciousness — it is a language model designed to be supportive

7. Prohibited Uses

You agree not to:

• Use the App for any illegal purpose
• Upload content depicting minors
• Attempt to reverse-engineer, hack, or exploit the App
• Use the App to harass, bully, or harm others
• Share your account credentials with others
• Use the App to generate content that promotes violence or discrimination

8. Intellectual Property

All content, features, and functionality of Bloomy — including but not limited to text, graphics, logos, the Bloomy character design, icons, and software — are owned by us and are protected by copyright, trademark, and other intellectual property laws.

9. Limitation of Liability

To the maximum extent permitted by law, Bloomy shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, emotional distress, or loss of profits, arising from your use of the App.

Our total liability for any claims arising from your use of the App shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

10. Termination

We reserve the right to suspend or terminate your access to the App at any time, without notice, for conduct that we determine violates these Terms or is harmful to other users or the App.

11. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms in the App or on our website. Your continued use of the App after changes constitutes acceptance of the revised Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.
